GENERAL TERMS AND CONDITIONS


Article 1 – Definitions

• Host: the owner/manager of the vacation home.

• Guest: the primary renter (contracting party) and accompanying travelers/guests.

• Resort: the park/complex and common areas (including Blue Bay).

• Rental Period: the agreed dates of the stay.

• Security Deposit: the deposit as referred to in these terms.


Article 2 – Reservation & Formation

2.1 A reservation becomes final once the down payment has been received. By paying, the Guest confirms they have read and accepted these terms and the property description.

2.2 Prices are in euros, per property and per Rental Period; meals and beverages are not included. Any additional charges are listed separately.


Article 3 – Payment

3.1 Down payment: 25% of the rent within 3 days after confirmation.

3.2 Balance: 75% of the rent no later than 60 days before arrival.

3.3 Security Deposit: due no later than 7 days before arrival.

3.4 If (timely) payment is not made, the Host may—after a reminder—treat the booking as a cancellation and re-list the property.


Article 4 – Cancellation by Guest

4.1 More than 6 months before arrival: 0% of the rent due (free cancellation).

4.2 Between 6 and 3 months before arrival: 25% of the rent due.

4.3 Less than 3 months before arrival or in case of no-show/early departure: 100% of the rent due.

4.4 Any refund will be made within a reasonable period after cancellation, using the same payment method as used for the booking.

4.5 Lockdown exception: if Curaçao, due to a government measure, does not grant the Guest access during the Rental Period, a 100% refund applies. Other reasons are at the Guest’s own risk; cancellation insurance is recommended.


Article 5 – Cancellation by Host

5.1 In unforeseen circumstances, the Host may cancel; amounts already paid will be refunded. If this is not due to force majeure, the Guest additionally receives 20% of the rent as standard compensation.


Article 6 – Arrival & Departure

6.1 Arrival generally takes place between 4:00 PM and 8:00 PM, unless otherwise agreed.

6.2 Preferably, a few days before arrival, contact the local manager to agree on the exact time and meeting location. Contact again if changes arise due to unforeseen circumstances. If this procedure is not followed, the Host cannot be held responsible for any failure to take possession of the property upon arrival.

6.3 The property must be vacated by 11:00 AM on the day of departure.

6.4 In case of loss of key(s), reasonable replacement costs will be charged.


Article 7 – Occupancy & Use

7.1 Maximum of 6 persons per property, unless otherwise approved in writing in advance. If exceeded, access may be refused; if found afterwards, a reasonable surcharge per extra person (max. 25% of the rent per person) and/or set-off against the deposit may apply.

7.2 No parties, events or loud music. Respect quiet hours and neighbors.


Article 8 – Pets & Smoking

8.1 Pets are not allowed. Smoking is permitted outdoors only.


Article 9 – Security Deposit
 9.1 Deposit per villa: €350. Refund within a few days after check-out, less any damage, missing items, extra cleaning, and utility charges as per Article 
10.

9.2 Refund of the deposit will be made within five business days after check-out, after set-off of consumption and any damages.


Article 10 – Utilities (water & electricity) and Energy Use

10.1 The rent excludes water and electricity consumption. Settlement occurs via the Security Deposit at check-out, based on the actual Aqualectra rates at the time of check-out. Begin and end meter readings are recorded together with the Guest at check-in and check-out.

10.2 This system encourages conscious energy use. Indicative guideline: approximately € / US$14 per villa per night when using bedroom A/C at night only.

10.3 The living-room A/C typically adds about € / US$ 2 per hour while running.


Article 11 – Cleaning & Linen

11.1 The property is handed over clean; report any issues immediately so they can be remedied.

11.2 Bed and bath linen are provided: 1 beach towel and two bath towels per person.

11.3 Upon departure, leave the kitchen clean: wash and dry used items and return them to the cabinets. If you use the dishwasher, let the program run and leave it empty before departure.

11.4 Household waste must be placed in the garbage cans along the road. If excessive final cleaning is required, additional costs may be charged against the deposit.

11.5 Use beach towels on loungers/chairs when wearing wet swimwear and sunscreen. Do not place wet or hot items directly on furniture.


Article 12 – Maintenance & Access

12.1 The Host and/or third parties engaged by the Host may, after consultation, request access for necessary (urgent) maintenance, garden/pool service, or legal inspections. The Guest grants reasonable cooperation.


Article 13 – Tropical Fauna and Pests

Curaçao is a tropical island. Despite preventive measures, insects and small animals (including mosquitoes, ants, spiders, cockroaches, geckos/salamanders, mice or rats) may occur. This is inherent to the tropical climate and does not constitute a defect of the property, nor does it entitle the Guest to any refund, discount, damages, or termination.


Article 14 – House Rules (summary)

• Be quiet after 10:00 PM and respect neighbors and Resort rules.

• Park in designated spaces.

• No open-flame BBQ on the veranda or elsewhere in Blue Bay; an electric BBQ is available.

• Toilet use: paper only—do not flush anything else.

• Do not hang laundry outside on balconies or in view of other villas.

• Common Areas are for residents/guests only.

• Do not feed cats; do not move or cover the Biogents BG-Mosquitaire mosquito trap.


Article 15 – Complaints & Service

15.1 Report defects or complaints as soon as possible and in any case within 24 hours after check-in, and grant the Host a reasonable opportunity to remedy. Record serious matters with photos/video.

15.2 Information about third-party facilities/activities (such as resort amenities and excursions) is indicative; opening times and availability may change.


Article 16 – Force Majeure & Disruptions

16.1 The Host is not liable for disruption, change, or prevention of the stay due to force majeure (including limited/no supply by utility companies, works by government/Resort/third parties, natural circumstances, flight delays). Interruptions of water/electricity by the utility company qualify as force majeure.

16.2 Situations as described in 16.1 do not constitute a defect of the property and do not entitle the Guest to any refund, discount, damages, or termination. The Host will endeavour to mitigate consequences and, where possible, facilitate restoration.


Article 17 – Liability & Insurance

17.1 Use of the property, garden, pool, and facilities is at the Guest’s own risk. The Host is not liable for loss/theft/damage of belongings, nor for consequential or indirect damages. The Guest is liable for damage caused by them/their guests and must report incidents immediately.

17.2 The Guest is advised to take out travel and cancellation insurance.


 Article 18 – Privacy & Identification
 18.1 Where needed for legal registration/Resort access/safety, the Host may request the Guest’s identification details and process them in accordance with applicable regulations.


Article 19 – Governing Law & Forum

19.1 The law of Curaçao governs this agreement. Disputes that cannot be settled amicably will be submitted to the Court of First Instance of Curaçao.  


House Rules – full text (Blue Bay & villa)

• Be considerate of neighbors and other Blue Bay guests and residents.

• No loud noise or music in the villa or in Common Areas.

• Quiet hours: 10:00 PM–8:00 AM.

• Park only in designated spaces.

• Pets are not allowed in the villa.

• Common Areas are for residents or guests of our villas only.

• Household waste belongs in the garbage cans along the road; do not place bags beside the bins and close the lids properly.

• Toilet use: paper only—do not flush anything else.

• Do not hang laundry outside on balconies or in view of other villas.

• No open-flame BBQ on the veranda or elsewhere in the Blue Bay Village area; an electric BBQ is available.

• Smoking is allowed outdoors only.


Info about our cats: please do not feed the cats. The cats are part of our eco-friendly pest control and are well taken care of (there are even “cat hotels”).

Mosquito trap: Blue Bay makes every effort to control mosquitoes. We use the Biogents “BG-Mosquitaire” trap as an eco-friendly method against, for example, tiger and yellow fever mosquitoes. The trap is on the veranda; do not move or cover it.
