Terms of Use

The tenant declares to be familiar with the fact that the rent is exclusive of water and electricity consumption. The tenant must pay these costs to the landlord at check-out in Euro by settlement through the deposit. The landlord will transfer the remaining amount to the tenant within a couple of days. The meter reading will be noted with you at check-in and check-out. We use the actual rates applied by Aqualectra (the utility company of Curaçao) at the moment of check-out.

General rental conditions

Article 1. General

The lessor cannot be held responsible for any disruption, alteration, or prevention of the tenant’s stay if this results from unforeseen or insurmountable events beyond his control. The landlord cannot be held responsible for inconveniences caused by the work of third parties, such as a municipality, province, Blue Bay resort, etc. Nor can the landlord be held responsible for interruption of water or electricity if this is the result of force majeure (i.e., limited or no supply by the local utility company). The landlord declines any responsibility for loss, theft, or damage to luggage, personal belongings, or vehicle, as well as for costs resulting from not reaching the vacation home or apartment on time due to delay.

Article 2. Reservation and price

A reservation is valid when the Landlord has received the required first installment. Paying this means that the Tenant has noted and agrees with the above-mentioned general rental conditions and the full description of the property he has rented. Landlord's prices are calculated in Euro, are per property for the rental period. Costs of meals, drinks, etc., are never included in the price. Additional fees, such as consumption costs, etc., are never included in the price unless otherwise stated.

Article 3. Payment of the rent

25% of the rent and deposit must be paid in advance for each reservation. The landlord must receive this first installment within three days after signing the contract. The second instalment must be received by Landlord 60 days before the start of the stay in the vacation home. The tenant will receive a letter/email requesting to pay the remainder within three working days if this has not happened. If this does not happen, this will be seen as a cancellation of the holiday home by the tenant, and the cancellation conditions of Article 4 will apply. The landlord then has the right to offer the vacation home again for rent.

Article 4. Cancellation by the Hirer

If, for any reason, the tenant cannot wants not or will not accept the vacation home on the agreed date, he must immediately inform the Landlord of this. Notification by telephone should be confirmed in writing or by email. If the tenant cancels the agreement in the period that is more than three months before the start date of the rental period, he will still owe 30% of the rental price; Cancellation less than three months before the arrival date will not lead to any refund of money paid. If the tenant only announces on the starting date or during the rental period that he will no longer be using the rented property, he will still owe the total rental price. If Curaçao goes into lockdown, as a result of which the renter is not allowed on Curaçao, the renter can cancel free of charge and get the total rent back. We advise you to take out cancellation insurance to cover the risk of other calamities.

Article 5. Cancellation by the lessor

If the landlord has to cancel a rental agreement due to unforeseen circumstances, the tenant will be informed immediately, and a refund of deposits will be made immediately. If the cancellation of the rental agreement is not the result of force majeure, the Landlord will also pay an additional amount of 20% of the rental sum, being the usual compensation for damage and inconvenience.

Article 6. Complaints and Disputes

No complaints will be accepted if they are not reported by telephone within 48 hours of taking possession of the vacation home, followed by an email confirming receipt or a registered letter. The same rule applies if something serious happens during the stay in the vacation home. If the tenant refuses to take possession of the vacation home because the state of the house does not correspond to what he may reasonably expect, he should immediately contact the landlord. If it is impossible to reach an agreement, he should have the complaint verified by an expert, a bailiff, or a notary to obtain an objective opinion. In case of disagreement regarding the execution of this agreement, the parties agree that disputes shall be submitted to the court of the first instance in Curaçao.

Article 7. Description

All loose-leaf information or information on websites regarding the vacation home, the layout, the furniture, or the relevant facilities has been provided in good faith. If there is a material change in this information between the time of reservation and the start of the rental period, the Lessor will inform the Lessee. Suppose, despite everything, the information regarding the vacation home, the layout, the furniture, the maximum number of occupants, or the relevant facilities turns out to be incorrect. In that case, the Lessee must immediately inform the Lessor so that the latter can remedy the situation. All information regarding tourism and sporting activities is provided by third parties and is not the responsibility of the Lessor.

Article 8. Arrival and departure

The arrival in the vacation home typically takes place between 16 and 20 hours unless otherwise agreed. It is recommended to contact the person in charge of the reception the evening before departure to arrange a precise time and place and contact him again if the appointment has to be changed due to unforeseen circumstances. If this procedure is not followed, the landlord cannot be held responsible for not taking possession of the house when the tenant arrives. The vacation home must be vacated no later than 11 am on the day of departure.

Article 9. Maximum number of occupants

No more than six persons may stay in the vacation home unless the lessor has granted prior permission. If this number is exceeded, the person who arranges the reception can deny this extra person access to the vacation home. Suppose at a later time, without the knowledge of the person who arranges the reception, additional persons come to stay in the house. In that case, there will be an immediate claim of 25% of the rent per extra person, which, if necessary, will be deducted from the deposit.

Article 10. Pets

It is not permitted to bring a pet into the vacation home.

Article 11. Guarantee

For the villas, a deposit of € 350/per villa must be paid. This deposit will be returned within a few days after check-out, if necessary, after deducting costs for repairing any damage found to the house. The consumption costs of water and energy will be deducted from the deposit.

Article 12. Additional costs

At the end of the stay, the Tenant must pay the additional costs as stated in the lease (water and electricity consumption).

Article 13. Cleaning

The house must be found clean and tidy. If this is not the case, it must be immediately reported to the person who arranges the reception so that he can repair it. Furthermore, the tenant must report this to the landlord within 24 hours. Upon departure, the tenant must leave the house clean and tidy, with particular attention to the sanitary facilities, the kitchen, the glassware, and the floor. The waste should be deposited in the garbage cans along the road.

Article 14. Linen

Under sheets, sheets, pillows, beach towels, bath towels, bath mats, and kitchen towels are provided in the house.

Article 15. Relevant rules for Owners and their Guests to hang in the villa by the house rules (based on P-section house rules, deed, and Blue Bay Resort rules)

  • 🎧No loud noise or music in the villa and the common areas.
  • 🎧No noise between 10 pm and 8 am.🎧.
  • 🚗Parking in designated areas only.
  • 🐕No pets can be brought to the villa.
  • Common areas are only for residents or guests of our villas.
  • 🗑No garbage items may be placed next to the bins in the common areas. Only household garbage can be disposed of. Please close the containers.
  • 🚽Only toilet paper can be deposited in the toilets. Please do not flush anything else through the toilets.🚽.
  • 🧺No laundry outside the balconies or insight of other villas.
  • Absolutely no barbecue usage of any kind allowed on the porch or any other place in the Blue Bay Village area. As a substitute we offer an electric griddle
  • 🚭Smoking is only allowed outside🚭.


Info about our cats:

Please do not feed our cats. The cats are part of our environmentally friendly pest control and are very well cared for. There are even cat hotels!

Mosquito(trap):

Blue Bay does its utmost to control the mosquitoes. We use the Biogents mosquito trap "BG-Mosquitaire" as an excellent and environmentally friendly agent specially developed to control Asian tiger mosquitoes and yellow fever mosquitoes. To the mosquito, the trap looks like a human. The sturdy plastic trap is placed on the porch and will catch many mosquitoes
